This privacy policy is designed to protect your privacy and personal information (“Privacy Policy”). This privacy commitment only applies to data gathered by the Services, and does not apply to any other information or web sites. By using the Services you agree to be bound by the terms and conditions of this Privacy Policy. If you do not agree please do not use or access our Services. Please read this Privacy Policy to learn more about the ways in which we use and protect your personal information. All capitalized terms appearing in this Privacy Policy and not defined herein shall have the meaning ascribed to them in the User Agreement.

This Privacy Policy describes the information, as part of the normal operation of our services; we collect from you and what may happen to that information. By accepting the Privacy Policy and the terms and conditions of the membership (available on the Website), you expressly consent to our use and disclosure of the information provided by you on the Website (your “Personal Information”) in accordance with this Privacy Policy.

  1. Information collected by the Services
    1. When you use our Services, we collect and store your Personal Information from you. Our primary goal in doing so is to provide a safe, efficient, smooth and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our Services to make your experience safer and easier. Importantly, we only collect Personal Information about you that we consider necessary for achieving this purpose. empowerM automatically lists information about health care professionals, including doctors, and health care organizations on its Services. Such information is displayed when patients search for any health care professional or organisation and may be used by the patients to request for an appointment or choose to enlist their service
    2. In general, you can browse the Website without revealing to us your identity or Personal Information about yourself. Once you give us your Personal Information, you are not anonymous to us. To fully use our Services, you will need to register as a member using our online membership registration form, where you may be required to provide us with your name, date of birth, contact number, email id, user id, password, medical certificate, identify proof, residential address or address of place of business, billing information, bank account details and other Personal Information as indicated on our Services. Where possible, we indicate which fields are required and which fields are optional. We may automatically track certain information about you through IP, GPS based upon your behavior on our Services. We use this information to do internal research on our users’ demographics, interests, and behavior to better understand, protect and serve our users. This information is compiled and analyzed on an aggregated basis. This information may include the URL that you just came from (whether this URL is on our Website or not), which URL you next go to (whether this URL is on our Website or not), your computer browser information, and your IP address. We use your GPS location to communicate the location of emergency to your designated Care Givers, Emergency Contact, Hospital and Doctors. Your location is also communicated to the Ambulance Provider, First Responders, Police Patrols, Ambulance Driver and Motor Vehicle Inspectors.
    3. We use data collection devices such as “cookies” on certain pages of the Website to help analyze our web page flow, measure promotional effectiveness, and promote trust and safety. “Cookies” are small files placed on your hard drive that assist us in providing our services. We offer certain features that are only available through the use of a “cookie”. We also use cookies to allow you to enter your password less frequently during a session. Cookies can also help us provide information that is targeted to your interests. Most cookies are “session cookies,” meaning that they are automatically deleted from your hard drive at the end of a session. You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on the Website and you may be required to re-enter your password more frequently during a session. Additionally, you may encounter “cookies” or other similar devices on certain pages of the Website that are placed by third parties. For example, if you view a web page created by a user, there may be a “cookie” placed within that web page. We do not control the use of cookies by third parties.

  2. Categorization of Information : We categorize your Personal Information as follows:
    1. Membership Information: Information which you provide when you register as a member, which may include some or all of the following: (i) Information about your personal identity such as gender, marital status, age, preferences, likes and dislikes etc.; (ii) Your contact details such as your physical addresses, postal addresses, telephone and fax numbers and other related information;
    2. Health Information (for patients only): Your health history with us including, but without limitation, medical history, visit history, emergency health record, diet history, diagnosis history, family health history, habits, current medications and other protected medical and health information. We also collect and store content such as notes, prescriptions, diagnosis reports, etc., that you upload, download or access through the Services. To the best possible extent this information is segregated from the Personal Information. We have segregated Personally Information from the Health Information using complex algorithmic linkage which can only be done by our Services. This makes it extremely hard for any potential hacker to co-relate the Personal Information with Health Information.
    3. Service Usage: Information about your navigation using our Services.
    4. Log information: Information such as your web request, IP address, browser type, browser language, device id (IMEI), device model, device resolution, MAC address, GPS Location, name of the carrier, date and time of request.
    5. Transactional Information: Transactional history (other than banking details) about your e-commerce activities.
    6. Correspondence Information: Content, information about your correspondents, and the destination/origin of communications between you and any other person using our Services, which include email communications, blog, chat room and discussion board communications, instant message communications, experts forum communications, , membership of mailing lists etc.
    7. User IDs: Your usernames, passwords, email addresses and other security-related information used by you in relation to our Services.
    8. Stored Information: Data either created by you or by a third party and which you wish to store on our servers such as image files, documents etc. or the data stored on the servers of the external service providers of the Services, while accessing the Services or the data stored by you on your mobile phone while accessing the Services.

Sharing of information in discussion forums(Q&A):  Any of your information which you provide when you use discussion forums including (without limitation) any blog, community or discussion board, is not confidential, does not constitute Personal Information, and is not subject to protection under this Privacy Policy. Since such public environments are accessible by third parties, it is possible that third parties may collect and collate and use such information for their own purposes. You should accordingly be careful when deciding to share any of your Personal Information in such public environments. Information, which is disclosed publicly, is also shared with our affiliates, third party service providers, sponsors of competitions etc. unless expressly stated otherwise. We are not liable to you or any third party for any damages that you or any third party may suffer howsoever arising from your disclosure of Personal Information in any public environment. You accordingly disclose information in a public environment at your own risk.
  4. Protection of Personal Information: empowerM values the privacy of information pertaining to its Users. We only collect your Personal Information to conduct our business and to enable us to deliver and improve our Services. We do not for any reason whatsoever sell or rent your Personal Information to any third party or otherwise trade on it without your explicit consent. We do not use or disclose information about your individual usage of our Services or any information that you may give us, such as your name, address, email address or telephone number, to any outside sources. empowerM will not use information about you without your permission and will provide the means for you to manage and control the information that you have provided. We do reserve the right to create collateral and make copies of the information shared by you through our Services, without your explicit permission. We will only disclose your Personal Information in accordance with this Privacy Policy. If we want to use it for any other purpose, we will obtain your prior written consent. If you decline to submit Personal information to us, then we will unfortunately not be in a position to provide some of the Services to you. From time to time we may reveal general statistical information about our Services and visitors, such as number of visitors, number and type services availed, etc. We will enable you to communicate your privacy concerns to us and that we will respond to them appropriately. empowerM does not disclose any personal information to advertisers and for other marketing and promotional purposes that could be used to personally identify you, such as your password, credit card number and bank account number. All information stored on our server including but not limited to profiles of the Users, metadata and such other proprietary information, etc., shall not be copied by any User unless authorized by empowerM.

Our use of your information:  We use the information we gather on our Services, whether personal, demographic, collective or technical, for the purposes of operating and improving the Services, fostering a positive user experience, and delivering the services that we offer. We use your Personal Information in the file we maintain about you, and other information we obtain from your current and past activities on the Services to: resolve disputes; troubleshoot problems; help promote safe trading; collect fees owed; measure consumer interest in the services provided by us, inform you about online and offline offers, products, services, and updates; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our User Agreement; and as otherwise described to you at the time of collection. At times, we may look across multiple users to identify and resolve problems in relation to the functioning of the Services. We may compare and review your Personal Information for errors, omissions and for accuracy.7. If you choose to use our Services and provide us with your financial information, we use your address and billing information to bill you and provide associated support. You agree that we may use Personal Information about you to improve our marketing and promotional efforts, to analyze site/app usage, improve the Services content and product offerings, and customize the Services content, layout, and services. These uses improve the Services and better tailor it to meet your needs, so as to provide you with a smooth, efficient, safe and customized experience while using the Services. You agree that we may use your Personal Information to contact you and deliver information to you that, in some cases, are targeted to your interests, such as targeted banner advertisements, administrative notices, product offerings, new services, promotions and communications relevant to your use of the Services. By accepting the User Agreement and Privacy Policy, you expressly agree to receive this information. When such services are offered user will have an option to opt out. If you do not wish to receive these communications, we encourage you to opt out of the receipt of certain communications. The following are examples of some categories of persons to whom we would share your information with from time-to-time.

    1. Advertisements: We do not have advertisements now.
    2. External Service Providers: We may use third parties that we refer to as external service providers to facilitate or outsource one or more aspects of the business, product and service operations that we provide to you on the Services (e.g., search technology, discussion boards, bill collection, affiliate and rewards programs, co-branded credit cards) and therefore we may provide some of your Personal Information directly to these external service providers. These external service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information we provide them for any other purpose except to facilitate the specific outsourced Services related operation, unless you have explicitly agreed or given your prior permission to them for additional uses. In some instances, the external service provider may collect information directly from you (such as for Services surveys) and such data might remain on their servers for a certain span of time. In these cases, you will be notified of the involvement of the external service provider, and all additional information you provide them and their additional uses will be strictly up to you. Governmental authorities: We cooperate with all governmental authorities, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights, to help protect you and the community from bad actors. Therefore, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, we can (and you authorize us to) disclose your name, city, state, telephone number, email address, Member ID history, fraud complaints etc without a subpoena. Without limiting the above, in an effort to respect your privacy we will not otherwise disclose your Personal Information to law enforcement or other government officials without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss; or report suspected illegal activity.

Due to the existing regulatory environment, we cannot ensure that all of your private communications and other Personal Information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose Personal Information, information about your interactions on the Services to the government or third parties under certain circumstances, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your Personal Information that they collect from the Services. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your Personal Information, interactions on the Services or private communications will always remain private.

In addition to the above, we disclose the following information to Users who are chosen by you as (i) your Doctor/Health Care Professional or/and (ii) your “Care Giver” as being person responsible for your well-being: your address, age, gender, profile picture, insurance details, family health history, your habits, contact information of your emergency contacts, your medical history, your visit history, your diet history and your emergency health record or/and (iii) your “Emergency Contact” as being a person who is willing to assist you in case of an emergency or/and (iv) “First Responders” as being a person who has been trained on First Aid skills and within 1km of the emergency incident to assist and deliver first aid to the person in emergency till the ambulance arrives or/and (v) Police personnel within whose jurisdiction the emergency falls in, to enable them in assisting you in case of an emergency or/and (vi) Motor Vehicle inspectors within whose jurisdiction the emergency falls in, to enable them in assisting you in case of an emergency or/and (vii) HR personnel/Administrators in the company you are employed in to enable them in assisting you in case of an emergency or/and (viii) Administrators in your educational institute you are studying in, to enable them in assisting you in case of an emergency  : your address, age, gender, profile picture, insurance details, contact information of your emergency contacts and your emergency health record.
    7. empowerM may also disclose or transfer Users’ Personal Information and other information, to another third party as part of reorganization, transfer of ownership and control, or a sale of the assets of empowerM. Any third party to which empowerM transfers ownership and control or sells its assets will have the right to continue to use the personal and other information that Users provide to us. In such an eventuality communication will be sent to you by email and you may choose to opt out of this service.

In the event you are a health care professional, health care provider or a health care organisation, you shall be entitled to unrestricted access to information on the Services provided by patients who choose you as their health care professional, health care provider or health care organisation. You agree that you shall be responsible for the protection of the privacy of the information being made available to you and that empowerM shall not be responsible or liable for the same, in any manner whatsoever.
    2. In the event you are a patient, we share certain categories of information we collect from you in the ways described in this Privacy Policy, including as described below: If you elect to complete a Basic Medical Data form using the Services in advance of an appointment, we may share your Basic Medical Data with your doctors. Any information you choose to provide and make available to third parties via our services should reflect how much you want others to know about you and the individual(s) about whom you created the profiles and accounts. Please consider carefully what information you disclose in the patient profiles and your desired level of anonymity. You can review and revise the information contained in your profiles at any time. We recommend that you guard your sensitive information. Moreover the User who is representing you as the assigned Owner/Care Giver/ emergency contact will receive the information and can contact the provider to get perspective on the patient’s health.
    3. All the information provided on the Services by a User, including Personal Information, is voluntary. The User has the right to withdraw his/her/its consent at any time, in accordance with the terms of this Privacy Policy and the terms of use, but please note that withdrawal of consent will not be retroactive. Always use caution when giving out any Information about yourself or your family members in use of any Services. empowerM does not control or endorse the content, messages or information found in any Services and, therefore, empowerM specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Services, and you agree that you waive any claims against empowerM relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against empowerM relating to same.
  1. Emergency Tracker

In the event of an emergency involving you (for the purposes of this clause 8, a patient), you hereby agree that your emergency tracker containing your location, emergency health record, contact information, age, gender and insurance information is made available with unrestricted access in order (i) to assist emergency personnel, doctors and other healthcare professionals who may otherwise not have access to the same and (ii) to keep your emergency contacts updated about your situation.

Please note that the emergency tracker services is being provided by G1 (Jeevan) Health through a complex integration of services which include the services provided by third parties such as the mobile network provider, the server hosting provider, the SMS provider, etc., and is dependent of factors beyond the control of G1 (Jeevan) Health such as the mobile phone of the User, the mobile network of the Users provider, availability of balance on the User’s mobile phone, etc. Therefore, the response to an emergency would depend on the ability of the emergency personnel, doctors and healthcare professionals involved and such third parties and external factors as described above. empowerM shall, in no way, be responsible in the event the emergency tracker is unable to provide or delays in providing assistance to the emergency victim.

  1. Surveys

At times, empowerM conducts User surveys to collect information about patients’ preferences. These surveys are optional and if patients choose to respond, their responses will be kept anonymous. Similarly, empowerM may offer contests to qualifying patients in which we ask for contact and demographic information such as name, email address and mailing address. None of this information is shared with third parties, except in summary form, if at all. The demographic information that empowerM collects in the registration process and through surveys is used to help empowerM improve its Services to meet the needs and preferences of patients. This may include targeting advertising to Patients about our Services. Information we gather through a contest may also be disclosed to third parties, as necessary, for prize fulfillment and other aspects of any contest or similar offering.

  1. Mobile applications

The Users may avail of the Services provided by empowerM by way of mobile applications as well. For patients, the mobile application is “G1 (Jeevan) Health4Me – Health Emergency App for Life” and for health care professionals, the mobile application is term “G1 (Jeevan) Health”. All the terms of the User Agreement and the Privacy Policy shall be applicable for the usage of the mobile applications and storage of information on the same.

  1. Miscellaneous
    1. Identity: To protect your privacy and security, to the extent possible, on a best efforts basis, we will verify your identity, by examining the documents and information provided by you, before granting access or making changes to your personally-identifying information. Notwithstanding the foregoing, please note the verification process shall be restricted only the health care professionals and health care organisations. If you are a registered member of our Services, membership ID and Password are required in order to access your profile information. empowerM shall not be responsible or liable, in any manner whatsoever, in the event the information provided by you is false or misrepresenting in any way.
    2. Security: When you place orders or access your account information, we offer the use of a secure server. The secure server software (SSL) encrypts all information you put in before it is sent to us. Furthermore, all of the customer data we collect is protected against unauthorized access. To prevent unauthorized access, maintain data accuracy, and ensure correct use of information, we will employ reasonable security practices and procedures and current Internet security methods.
    3. Your consent and change: By using the Services and/ or by providing your information, you consent to the collection and use of the information you disclose by the Services in accordance with this Privacy Policy.
    4. Changes to Privacy Policy: If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.
